§ Preliminary Notice – Nature of Services
The travel services provided by Baraka Trips Limited constitute a package where applicable. Baraka Trips acts as the Organiser of these packages and is fully responsible for the proper performance of the package as a whole.
These Terms & Conditions incorporate and reflect the applicable rights and obligations under the Package Travel and Linked Travel Arrangements Regulations 2018 (PTR 2018). Where a client’s booking is subject to the PTR 2018, those rights apply in addition to the contractual terms set out herein and cannot be waived.
01 Booking and Contract
All bookings are on request until confirmed in writing by Baraka Trips. A booking becomes confirmed when Baraka Trips issues written confirmation and the required deposit payment is received.
The person making the booking confirms that they are authorised to accept these Terms & Conditions on behalf of all travellers in the reservation, including any minors. The lead traveller is responsible for communicating all relevant conditions to all members of the travelling party.
Pre-contractual information provided by Baraka Trips (including the itinerary, price, and package description) forms an integral part of the contract and will not be altered without the traveller’s express agreement.
02 Scope of Services
Baraka Trips provides land travel arrangements only, which may include:
- Accommodation
- Transportation
- Local guides
- Entrance fees and activities
- Meals and experiences (where specified)
Flights or flight-related services are not included unless explicitly stated in writing. All services are provided through carefully selected independent local suppliers.
03 Prices
All prices are quoted in EUR unless otherwise specified. Prices are based on supplier rates, taxes, and operational costs at the time of quotation. Baraka Trips reserves the right to adjust prices before booking confirmation if changes occur in supplier costs, applicable taxes, exchange rates, or operational conditions.
Once a booking is confirmed and the deposit received, the agreed price will remain fixed, subject only to the following permitted post-confirmation adjustments:
- Changes in transportation costs, including fuel prices;
- Changes in taxes or fees applicable to the travel services included in the package;
- Changes in exchange rates relevant to the package.
Any post-confirmation price increase will not exceed 8% of the total package price. If a proposed increase exceeds 8%, the traveller has the right to cancel the contract without paying any cancellation fee and receive a full refund of all payments made. Baraka Trips will notify the traveller of any price increase no later than 20 days before the start of services.
04 Payment Terms
To confirm a booking, a deposit is required as agreed in writing at the time of booking (typically 30% of the total booking amount, unless otherwise agreed in writing). The remaining balance must be paid no later than 10 days before the start of services, unless otherwise agreed.
For bookings made within 30 days of travel, full payment may be required at the time of confirmation. Failure to pay the balance on time may result in cancellation of the booking and application of the cancellation charges set out in Clause 6.
05 Changes Requested by the Client
Clients may request changes to their booking in writing. All changes are subject to availability, supplier conditions, and potential additional costs.
Certain services (such as entrance tickets, special reservations, or non-refundable hotel rates) may not be changeable once confirmed. Any costs incurred as a result of a change request will be passed on to the client.
Clients have the right to transfer their booking to another traveller who meets all the applicable conditions, provided that written notice is given no less than 7 days before the start of services. The transferor and transferee are jointly liable for the balance of the package price and any transfer costs.
06 Cancellation by the Client
Clients may cancel a confirmed booking at any time before the start of services by notifying Baraka Trips in writing. Cancellation takes effect on the date the written notification is received.
Operational costs already incurred by Baraka Trips (including non-refundable hotel deposits, entrance tickets, guide fees, transport prepayments, and supplier cancellation penalties) will always be charged, regardless of the cancellation date.
In addition, the following cancellation charges apply to the remaining booking amount:

Where applicable, refunds will be processed within 14 days of the effective cancellation date, net of any charges due.
6A. Cancellation in Extraordinary Circumstances
A client may cancel the contract without paying any cancellation charge if unavoidable and extraordinary circumstances occur at the place of destination — such as significant security threats, natural disasters, or government travel restrictions — which significantly affect the performance of the package. In such cases, the client is entitled to a full refund of all payments made within 14 days.
07 Partial Cancellation
If one or more travellers cancel but the trip continues for the remaining participants, the cancellation charges in Clause 6 apply to the cancelled traveller(s). The price for the remaining travellers may be recalculated if the cancellation affects room occupancy or group-based pricing.
08 Non-Refundable Services
Certain services may be non-refundable once booked, including but not limited to:
- Train and ferry tickets
- Entrance tickets (including Alhambra tickets)
- Special events and pre-paid experiences
- Non-refundable hotel rates
These services will be charged at 100% regardless of the cancellation date. The client will be informed of any such non-refundable components at the time of booking.
09 Changes and Cancellation by Baraka Trips
9A. Minor Operational Adjustments
Baraka Trips reserves the right to make reasonable operational adjustments where necessary, including modifications to itinerary timing, sequence of visits, routes, or accommodation of equivalent or higher standard. Such changes will only be made when necessary for operational reasons or traveller welfare, and the client will be informed promptly.
9B. Significant Changes
If, before the start of the package, Baraka Trips is constrained to make a significant alteration to any of the main characteristics of the package, the traveller will be informed without delay and offered the choice of:
- Accepting the proposed modification (with a price reduction if appropriate); or
- Cancelling the contract and receiving a full refund of all payments made within 14 days, without any cancellation charge; or
- Accepting an alternative package of equivalent or higher quality, where offered.
The traveller must communicate their choice within a reasonable period as specified by Baraka Trips. If no response is received, the contract may be terminated and a full refund processed.
9C. Cancellation by Baraka Trips
Baraka Trips may cancel the package before departure only if the minimum required number of participants is not reached (within the period stated in the booking confirmation), or due to unavoidable and extraordinary circumstances. In either case, the traveller is entitled to a full refund within 14 days, and to compensation where appropriate (except where cancellation is due to extraordinary circumstances).
10 Non-Performance and Lack of Conformity
Baraka Trips is responsible for the performance of the travel services included in the package, irrespective of whether those services are performed directly or by third-party suppliers.
If any travel service is not performed in conformity with the contract, Baraka Trips will remedy the lack of conformity without undue delay and at no additional cost to the traveller, unless remedying is impossible or disproportionate. Where the lack of conformity substantially affects the package and Baraka Trips fails to remedy it within a reasonable period, the traveller may terminate the contract and receive a proportionate price reduction.
The traveller is entitled to a price reduction for any period of non-conformity and to compensation for additional damage suffered, unless attributable to the traveller, an unconnected third party, or unavoidable and extraordinary circumstances.
11 Force Majeure
Baraka Trips shall not be liable for failure or delay caused by unavoidable and extraordinary circumstances beyond its reasonable control, including natural disasters, political unrest, government restrictions, strikes, epidemics or pandemics, and supplier closures.
In such cases, Baraka Trips will make reasonable efforts to provide alternative arrangements where possible. Where the package cannot be performed and the contract is terminated, refunds will be processed in accordance with Clause 9C.
12 Traveller Responsibilities
Travellers are responsible for:
- Holding valid passports, visas, and any other travel documents required for the destination;
- Compliance with entry requirements, health regulations, and vaccination requirements;
- Respecting local laws, customs, and the instructions of guides and local partners;
- Any damages or additional costs caused during the trip by their own conduct;
- Informing Baraka Trips of any special requirements, medical conditions, or accessibility needs before booking is confirmed.
For bookings involving minors, the lead traveller (as parent or legal guardian) accepts these Terms on behalf of all minors in the group and assumes full responsibility for their welfare during the trip.
13 Travel Insurance
Clients are strongly recommended to obtain comprehensive travel insurance prior to travel, covering:
- Trip cancellation and curtailment
- Medical expenses and emergency evacuation
- Personal accident
- Travel disruption and delays
- Loss of luggage and personal effects
Travel insurance is particularly important for travel to Morocco and destinations where medical or emergency costs may arise unexpectedly. Baraka Trips shall not be responsible for costs incurred due to the absence of adequate insurance coverage.
14 Suppliers
Accommodation, transport, and other services are provided by carefully selected independent third-party suppliers. While Baraka Trips maintains professional relationships with reputable local partners, the company cannot be held responsible for events outside its reasonable control related to these suppliers, provided that all reasonable care has been exercised in their selection.
15 Liability
Baraka Trips will perform its services with reasonable care and professional diligence and is responsible for the proper performance of the package as a whole.
To the maximum extent permitted by applicable law, the company’s liability for any claim arising from the package is limited to three times the total price of the package, except where the claim relates to personal injury or death.
Nothing in these Terms excludes or limits liability for death or personal injury caused by the negligence of Baraka Trips or its employees, or for fraudulent misrepresentation.
Baraka Trips accepts no liability for any failure attributable to the traveller; any failure attributable to an unconnected third party which was unforeseeable or unavoidable; or any unavoidable and extraordinary circumstances as defined in Clause 11.
16 Assistance During the Package
If a traveller is in difficulty during the package, Baraka Trips will provide appropriate assistance without undue delay, including information on health services, local authorities, or consular assistance, and help with alternative arrangements where necessary. A reasonable fee may be charged for such assistance if the difficulty was caused by the traveller’s own negligence or intentional misconduct.
Baraka Trips emergency contact details will be provided to the traveller prior to departure.
17 Complaints
If any issue arises during the trip, travellers must notify Baraka Trips immediately so corrective action can be taken. Failure to report issues during the trip may affect the outcome of any subsequent complaint.
Written complaints must be submitted within 21 days after the completion of services. Baraka Trips will acknowledge receipt within 5 business days and provide a substantive response within 28 days.
18 Data Protection
Personal data provided for booking purposes will be processed solely for the purpose of delivering the travel arrangements and fulfilling the contract. Data will be handled in accordance with applicable data protection regulations, including the UK GDPR.
Data will only be shared with third-party suppliers where necessary for the performance of the package. It will not be sold or disclosed to unrelated third parties.
19 Governing Law
These Terms & Conditions are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
Nothing in this clause affects any mandatory rights available to travellers under the laws of their country of residence.
Booking confirmation and/or payment of the deposit constitutes full acceptance of these Terms & Conditions.
